DISCLOSURE STATEMENT OF PROCESSING PERSONAL DATA
As Selesta Kozmetik Gıda Sanayi ve Ticaret Anonim Şirketi (“Company” or “Data Controller”), we respect the personal data we manage while carrying out our activities and prioritize the protection of fundamental rights and freedoms, particularly the right to privacy in the processing of personal data. Under the Law on the Protection of Personal Data No. 6698 (“KVKK”), we aim to inform you about how your personal data is collected, the purposes of processing, legal reasons, and our mutual rights and obligations through this clarification text.
- Collection, Processing, and Purposes of Personal Data
Your personal data may vary depending on the services and activities provided by our Company; it can be collected through automatic or non-automatic methods, either verbally, in writing, or electronically by responsible employees of our Company via face-to-face meetings, our website, or similar electronic communication tools. Additionally, as long as the legal relationship between you and our Company continues, your personal data may be updated and processed, and stored in printed and/or electronic form for as long as required by relevant legislation or necessary for the purposes for which they are processed. All necessary technical and administrative measures will be taken to ensure the protection and security of your personal data and to comply with storage requirements.
Your personal data is processed for the following purposes:
- To fulfill legal requirements related to Company activities,
- To ensure the legal and commercial security of real or legal persons who have a commercial relationship or business/service relationship with the Company, and to execute contract proposals and agreements in accordance with relevant legislation and Company policies,
- To ensure that Company activities are carried out in accordance with legislation, company policies, and procedures,
- For the purchase and delivery of products,
- For issuing invoices and fulfilling other legal obligations,
- To conduct market research and purchasing operations to provide our customers with better and more reliable service continuously, and to manage legal processes,
- To follow up on customer requests and complaints,
- To ensure workplace safety and maintain workplace peace and tranquility,
- To ensure information security,
- To secure the personal data of Company employees and job applicants, conduct recruitment processes, and prepare personnel files,
- To provide information to authorized institutions as required by relevant legislation.
- Transfer of Personal Data
Your personal data may be transferred to business partners, shareholders, affiliates, companies providing complementary or extended services, support service organizations, suppliers, contracted organizations, consulting firms, and public institutions and organizations, and law enforcement agencies in accordance with the purposes mentioned above and in compliance with the legal provisions and the conditions and purposes of personal data processing specified in Articles 8 and 9 of the KVKK.
Personal data cannot be transferred abroad without the explicit consent of the data owner. However, if one of the conditions specified in Articles 5 and 6 of the KVKK is present and there is a competence decision regarding the country to which the transfer will be made, sectors within the country, or international organizations, personal data may be transferred abroad by data controllers and processors. Your personal data is securely stored by our Company using a cloud system.
- Method and Legal Reason for Collecting Personal Data
Your personal data is collected in any verbal, written, or electronic form for the purposes specified in the first part of this text to provide our products and services within the established legal framework and to enable our Company to fully and accurately fulfill its contractual and legal obligations. The personal data collected for this reason can be processed and transferred in accordance with the conditions specified in Articles 5 and 6 of the KVKK and in accordance with the conditions stated in the first two sections of this text. In this context, your personal data may be processed without your explicit consent in line with the legitimate interests of the Company, provided that it does not harm your fundamental rights and freedoms, with the following exceptions: when it is clearly provided for in the laws, when there is a practical impossibility, for the establishment or performance of a contract, to fulfill the legal obligations of the Company, when the data is made public by you, or for the establishment, use, or protection of a right. Sensitive personal data can be processed based on your explicit consent; however, sensitive personal data other than health data may be processed without your explicit consent in cases provided for by law. Health data may only be processed by persons under an obligation of confidentiality for the purposes of protecting public health, preventive medicine, medical diagnosis, treatment, and care services, and planning and management of health services and financing.
- Rights of the Personal Data Owner
As a personal data owner, you have the following rights under Article 11 of the KVKK:
- To learn whether your personal data is processed,
- To request information about personal data if it has been processed,
- To learn the purpose of processing personal data and whether they are used appropriately for that purpose,
- To know the third parties to whom personal data is transferred within the country or abroad,
- To request correction of personal data if they are incomplete or inaccurately processed,
- To request the deletion or destruction of personal data under the conditions specified in the KVKK and to request that this operation be communicated to third parties to whom the personal data has been transferred,
- To object to the emergence of a result against the person by analyzing processed data through automated processes,
- To request compensation for damages in case of damage due to unlawful processing of personal data.
You can submit your request regarding the use of these rights in writing and with a wet signature, along with identity verification documents, to our address below, via registered electronic mail with a secure electronic signature, or in accordance with any method determined separately by the Personal Data Protection Board. Your requests will be evaluated within 30 days, and you will be informed of the result.
